news at 4:00 starts now. hi. i'm kai jackson. >> and i'm mary bubala. here's what people are talking about. we begin with that breaking news. a police-involved shooting at the university of maryland medical center, in towson. let's go live to captain jeff long in sky eye chopper 13 with more. captain jeff? >> reporter: gamp. this incident happened 2:30 p.m. here at st. joe's. an a baltimore county police officer was guarding a prisoner, in the emergency room, when the guard -- or the police officer and the prisoner got into a scuffle. and a weapon was discharged into a wall. some pepper spray was also sprayed. but no injuries have been reported.

as you can see, baltimore county police are on scene investigating this. and we'll bring you more information as we get it. reporting live from sky eye chopper 13, i'm captain jeff long. back to you. >> all right, captain jeff. thank you. we'll have updates for you on this breaking news as soon as we receive them. today's other big story, two days after an angry confrontation on a subway platform in midtown, manhattan, leads to the death of a 58-year- old man. the nypd makes an arrest. terrell brown reports for wjz, the grisly scene unfolded before a crowd of cameras. >> reporter: two days after this now infamous confrontation, on a subway platform in midtown, manhattan, led to the death of kesuk hahn. the grisly event unfolded before a crowded station and a number of cameras. >> the train was about three- quarters into the platform. you know, it was slowing down

by that point. but then after it started slowly going to the platform, you almost heard like a thud, a thud. like something was hit under the train. >> reporter: nayim davis, seen here arguing with the victim, was apprehended tuesday. the 30-year-old street vendor reportedly confessed after being spotted boy an off-duty police officer. he recently shaved his head but was recognized by this newsstand operator. >> he said that's not me. and i recognized him. >> reporter: charges against davis are expected today. and investigators have plenty of photographic eferredz from the scene. r. umar abassi, a freelance photographer, managed to take 41 shots, including one that landed on the front page of the new york post. >> it all happened so fast. i don't know what i could have done more, other than jump onto the tracks. and try to save him. but i'm not strong enough to lift a body off the tracks. >> reporter: a doctor tried to

revive hahn, but to no avail. so just how many could have helped before the train arrived is one question new yorkers are now trying to answer. terrell brown, new york. >> davis, charged with intentional second-degree murder and depraved indifference. child stabbing death. a southwest baltimore mother is released from the hospital and is now being held without bail, facing murder charges. denise is in the newsroom with more on nicole fitzgerald. denise? >> fitzgerald is facing murder and child abuse charges in the death of her 2-year-old son. police say she stabbed her son paris to death and then cut her own throat. when officers arrived at her home this weekend, they found 32-year-old nicole fitzgerald, standing in a stairwell, holding a knife pointed at herself. her toddler son was dead on the floor, from multiple stab wounds to the neck. fitzgerald is also charged with assault and reckless endangerment. mary? >> denise, thank you.

the little boy's aunt and uncle say fitz gerald has been dealing with mental health problems. new charges filed against a baltimore blogger who broadcast his standoff with police. officers tried to serve 47-year- old frank macarthur from two warrants from a gun case on saturday. when the five-hour standoff ended, police searched his home and found a weapon inside. so he is now facing two firearms charges. the hospital treating the duchess of cambridge is apologizing today, after a nurse reveals private details about kate's treatment. monica villamizar reports from london, the caller pretended to be the queen. >> reporter: the duchess of cambridge got a hospital visit from her sister pippa, and brother james. they arrived the day after a caller, pretending to be the queen, got through to kate's nurse. >> hello, good morning. >> hello there. could i please speak to kate, please, my granddaughter? >> reporter: the australian

d.j.s pulling the pranks fooled their way past the operator and to kate as well. the nurse reported that she was being hydrated. >> she was quite dehydrated when he came in. >> reporter: the nurse said she was sleeping. a second d.j., pretending to be prince charles replied, well, it's no palace, is it? >> when will you take me to the hospital, charles? >> when it will be right to come down there? maybe in the morning or something, if that's okay. >> i would suggest that any time after 9:00 would be suitable. >> the hospital director said he deplores the foolish prank. and perhapses to investigate the breakdown in phone security. >> the call went on for several minutes, complete with the queen's fake dogs barking in the background. the radio host from the australian station, today f.m., apologized for the hope. they said they thought they would be disconnected as soon

as the nurse heard their terrible arc cents. in -- accents. in london, monica villamizar, wjz eyewitness news. >> the hospital has provided care for the royal family for 70 years and said it deeply regrets giving out private details about the duchess. doug gansler is warning not to fall for a text message scam going around. the message says you've won a gift card to a well-known retail store and asks for personal information. legitimate contests would never ask for that type of information. gansler said you should delete the message and call your mobile phone provider and report the incident. a rescue on the road in harford county today. just before noon today, a car wound up 40 feet down an embankment. rescue crews made their way to the vehicle and found a 21-year- old man seriously injured. they carefully removed him. and he was hoisted up to the road. he was taken by medivac to shock trauma.

his condition is unknown at this time. well, carroll county police say 32-year-old rishita pendaa is the driver killed in a rush hour crash last night in finksburg. sky eye chopper 13 was over the scene. three cars were involved in the accident. pedaya was pronounced dead at the scene. two other people suffered nonlife-threatening injuries. the crash remains under investigation. hurricane sandy slammed into chrisfield, maryland, causing extensive damage. the state asked for help from fema. but the agency and the white house denied the request because not enough damage was done. >> reporter: when sandy flooded chrisfield, saving lives came first. >> is there water inside of your residence right now? >> yes, ma'am. >> i want to you try to stay calm. >> i have my grandson with me. >> reporter: taking stock of the damage came next. sitting just above the bay, many in the town took a big hit. >> my building took a big

beating. worst i've seen. >> clearly chris field took it the hardest. a lot of people have been swamped out of their homes. >> reporter: after seeing the damage, the governor asked for federal disaster relief. money for repairing infrastructure was aproved, but now, federal help won'ting coming to homeowners and businesses because not enough damage was done. fema director craig fugate said at this point, it does not support a presidential disaster declaration because it does is not based upon the trauma to the individual. our hearts go out to the victims. >> we need help. we need help. >> reporter: the reason? many who lost first floorsor roofs -- or roofs don't have the money for repairs. >> it comes hard to know when you have to pay that much money out of your pocket, which we don't have. >> we are a small town in a rural area. and you have to look at the delve of damage that we had, the level of the income in this area, which is extremely low.

the winds will eventually die down. 50 westminster. 58 down by the bay. and over in washington right now. we have that northwest wind. i told you, it was going to change direction from the south here. that warm air. front came through. light rain on the lower eastern shore this morning. cleared out quickly. got bright, sunshiny, nice december day. but unlike the last few days, it was a radical change. here's the front from maine into the georgia area and alabama. mississippi, some rain down there. the front moved through the area down there this morning, early on. and takes the rain and clouds with it. bright sunshine. the only problem is this front is going to kind of stall out, we think, down in the south. eventually may play into our weather. kind of wading back and forth. we have a risk of more clouds coming back friday. i think most of the rain will miss us. but over the weekend, into next week. we'll have a couple of chances of maybe some shower activity, down to 49 in boston. in the 30s to our north and west. so chilly air up there. but even winnipeg at 28 is not

hello. thanks for staying with eyewitness news. i'm denise koch. here's what people are talking about. we have an updet on the break -- update on the breaking news we brought you at the top of the show. a shooting at a baltimore county hospital. meganmeghan mccorkell has the latest on a shooting at the university of maryland st. joseph medical center. meghan? >> baltimore county police remain out here on the scene of university of maryland st. joseph's medical center. we're told this incident happened around 2:30 this afternoon. you can see the video from sky eye chopper 13 right here. baltimore county police officer was here inside the emergency room. we're told that he was guarding a prisoner who was being treated here. now, there was some sort of struggle between the roof -- officer and prisoner. we're told the officer, his gun was somehow fired. that gun discharged into the wall. officer did subdue the prisoner. we're told no one was injured in this incident. and back here live, we want to

show you that one of the entrances to the e.r. has been blocked off since that incident happened. they have someone out here from the hospital that has been rerouting people to another entrance to the e.r. so that the police can continue their investigation here. but again, no injuries after an officer's gun was discharged here in the e.r. we'll continue following this developing story. for now, i'm live in towson, i'm meghan mccorkell, wjz eyewitness news. >> we'll bring you more at 5:00 and 6:00. in front of the cameras, republicans and democrats are digging in their heels. if they do not find a compromise before the end of the year, taxes will gun for everyone. danielle notingham reports for the white house. >> reporter: house members left the capitol in the middle of the fiscal fight. they're notue due back -- not due back until next week. but house speaker john boehner is staying behind, ready to sit down and negotiate with the president. we can't sit here and negotiate

with ourselves. >> reporter: president obama is rejecting the republican proposal because it does not raise taxes on households making $250,000 a year. the gop is offering to close tax loopholes and limit deductions instead. >> the revenues on the table are going to come from guess who? the rich. >> reporter: they say if the bush-era tax cuts aren't extended for everyone, it will hurt everyone. and they invited people here to make their point. >> reporter: max olson opened an insurance company this year and is concerned he won't be able to add employees. >> you add their payrolls, plus an extra tax amount, then i may not be able to hire them because of it. >> reporter: president obama pressed his case tuesday, with ceos from some of the largest companies. >> i'm here to tell you, nobody wants to get it done more than me. >> reporter: the president wants to raise taxes on just about everyone in the room to balance the budget. >> we're not insisting on rates

just out of spite or out of any kind of partisan bickering. but rather because we need to raise a certain amount of revenue. >> reporter: the president said once republicans put rate hikes on the table, the two sides can find compromise. in washington, dan ye iel -- danielle nottingham, wjz eyewitness news. >> this turned into a standoff with republicans last year. the president warned the gop against a repeat of that fight. a maryland soldier is suing the pentagon for its policy, banning women from direct combat roles. kai is in the newsroom with more on her legal moves. >> that's right. staff sergeant jennifer hunt is suing the department of defense, as the civil affairs specialist in the army affairs. hunt has deployed to iraq and afghanistan, even earned a purple heart. hunt says the policy bang women from direct ground missions is illegal.

the department of defense says more than 14,000 jobs previously closed. two women have opened up to them this year. denise? >> all right. thank you, kai. hunt says this lawsuit isn't calling for a certain number of combat positions to be open to women. but instead to give women an equal opportunity to compete for the jobs. in wjz's healthwatch, a new study could change the standard of care in breast cancer treatment. new research suggests women should take tamoxifen for 10 years. twice as long as the current five-year recommendation. researchers at the university of oxford found breast cancer patients who took the drug longer, were less likely to die, and less likely to have their cancer come back. well, a former student at frostburg state university pleads guilty to second-degree murder in the stabbing of another student. 24-year-old sean e. liggins entered the plea monday in allegheny circuit court. 19-year-old courtney mccoy died in 2011, after she was stabbed several times. witnesses say the two women

were arguing in an off-campus home before the stabbing. people living in parts of queens, new york, are still recovering from the devastation caused by super storm sandy. as jessica schneider report the, that's why some are very angry with the city for handing out property violation notices. >> reporter: it is still a mess. roseanne and joe are still trying to clear up. but adding insult to injury, a citation notice from the city. >> it makes me angry. but it also is ridiculous. >> reporter: they got it on november 9th. 11 days after a tree landed on their home. they were cited for failure to maintain their property. about you they pointed out, it was a city tree and they were waiting for the city to remove it. >> it was over two weeks before someone came to remove it from the house. and we were patient enough for that. but to be slapped with a violation? >> reporter: the department of building said the citations are just a mere formality, a way for them to keep track of the

downed city trees. but people here say it is a permanent mark against their property. and they want the citation removed from their records. >> they're upset and not sure what will happen as a result of this violation. >> reporter: the department of buildings released this statement, we have been working closely with property owners and documenting damage as they occurred. these violations do not carry any monetary penalties and if any homeowner has a question, please call 911. >> i want the violation off my house, off my record. >> and as well as all our neighbors. >> and all our neighbors. >> reporter: the department of buildings says the citations will stand, but the cavallerries say they will continue to fight to get them removed. >> state lawmakers are now calling on the department to throw out the citations. things are beginning to cool back down, after a brief, spring-like break. taking a live look outside. some clouds around. there's a certain chill in the air. but it's in the that cold yet.

now, those are members of the muslim brotherhood, chanting in support of president mohammed morsy. they spent the day trying to chase anti-government protestors away from the gate. opponents are demonstrating against the decree morsey issued, giving himself, nearly unrestricted powers. we are learning more about the actions taken by a member of the u.s. coast guard, moments before his death, near the u.s.-mexico border. the coast guard says chief petty officer, terrell horn, fired several gunshots from an inflate believe boat to avoid getting shot. sadly, he died from head trauma after being struck by a propeller. officials say horn was trying to stop suspected drug smugglers. it has been nearly one year since the death of maddox turk osh, the boy who fell into the painted dog exhibit at the pittsburgh zoo.

we sat down to talk with the father about the accident and how they are coping with the accident. >> maddox a tendency to run sideways and look sideways, always checking himself outside, you know? and mady was always laughing. and his laugh always came from his stomach. >> reporter: most of us never met 2-year-old maddox duringosh. but ever since november 4th, we have known his face, his smile, those little glasses and the story of his fateful trip to the pittsburgh zoo, when he fell into the exhibit of painted african dogs and was mauled to death. an accident his grandfather says has forced his camly to -- family to cope, day by day, sometimes hour by hour. >> moments. if i see a picture -- if i read something, those are the hardest times for me. and i think as a grandparent, it's just moments. i don't even know what it's like for elizabeth and jason. >> reporter: pittsburgh police

and pittsburgh zoo both launched their own investigations into the circumstances surrounding what happened the day maddox died. while the public may have debated what happened, how it happened, who did what and why. the family has not. and as a father and grandfather, marty nooon says it's not a discussion he plans plans to have. >> i have never asked elizabeth what she did. i don't have a need to put her there. i'm only there to love her. let the other people ask her what she did. i'm here to support her. >> reporter: now, maddox, as you'll remember, fell into the exhibit, after his mother lifted him onto the railing to view it better. she will not be charged in her son's death. it has been four days since police say kansas city chiefs linebacker, jovel belcher shot and killed his girlfriend and himself. now we're hearing the frantic 911 calls from his mother.

>> reporter: belcher's mother, cheryl sheppard was staying with her son and his girlfriend, cassandra perkins at their home when the shooting occurred. police say belcher shot the 22- year-old before killing himself at arrowhead stadium. belcher's mother made the emergency call, after perkins was shot. on the phone, you can hear shep arounds -- sheppards begging for perkins to stay alive. >> she's still breathing. please hurry. i don't know how many times he got her. they were arguing -- >> but she's been shot? >> yes. >> okay. right now, is she awake? >> the ambulance is on the way. you hear me? you hear me? cassandra! hey. stay with me! >> belcher and perkins had a 3- month-old daughter. bel mper's mother -- belcher's mother is now caring for the baby. denise? >> a private memorial service was held for belcher earlier today in kansas city. actor frankie muniz is

opening up about a recent health scare. the former malcolm in the middle star revealed to twitter that he suffered a, quote, mini stroke last week. he said he was taken to an arizona hospital after becoming blind in one eye and having trouble speaking. muniz turns 27 -- 27 years old today. kidnapped and beaten to make home repairs? that is what a california man said happened to him. >> reporter: detectives say this morgan hill mansion was the scene of a full day of punches, death threats, kidnapping and home repair. >> so they beat him up and said fix this. >> correct. he was assaulted, threatened with his life to forced to do work at the house. >> reporter: investigators say monday morning, a handyman was lured into the sprawling five- bedroom, 4600-square-foot home, complete with pool and volleyball court. they beat the handyman, threatened to kill him, and get

this, made him fix the dish washer, a broken door, and other odd jobs. >> the victim was pretty shaken up and terrified by this whole incident. what he said, he was just trying to do it as he was told, to wait for the opportunity to escape. >> reporter: by nightfall, all three got into the victim's truck. on the way to the suspect's mother's house, again for more repairs. they pulled over at a gas station. the suspects went in to pay for gas and snacks and told the victim to stay put. he escaped. and police arrested the suspects as they pulled out. >> they don't seem like the brightest suspects. >> you know, it's kind of unknown what was going through their head. why they did what they did, and what were they planning to do? >> can i talk to you for a second about what happened yesterday? >> reporter: whatever -- whoever was the -- at the morgan hill house, didn't want to talk. morgan had done work for dejesus's mother two months ago. >> the work was not performed to the likes of the suspect at

the time. and on top of that, there was a dispute over services rendered. the victim wasn't paid entirely. that kind of boiled over into what occurred last night. >> the suspects are due in court tomorrow. in today's consumer watch report, new federal regulations on baby cribs at day cares are set to go into effect later this month. cribs with drop-down sides that could harm infants trying to pull themselves up are now banned. the crib must also have strong mattress support and anti- loosening nuts and bolts. the new regulations take effect on the 28t. a french shato -- chato is knocked down. workers knocked down the 18th century manor by mistake. they mixed up the chato with a smaller building on the property. the owner said he now plans on rebuilding an exact replica of the shato. must have a lot of money.
